The petitioners apprehend their arrest in connection with Nawada Town P.S. Case No. 579 of 2016 registered under Sections 341/323/447/448/354(B)/379/504/34 of the I.P.C.

pending in the Court of C.J.M., Nawada.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case with ulterior motive. There is case and counter case between the parties.

Considering the facts and circumstances of the case and the rival submissions of the parties, since admittedly the petitioners were on Police Bail and have not misused the privilege

Patna High Court Cr.Misc. No.3447 of 2017 (3) dt.27-04-2017 2/2 of bail, it is directed that if the petitioners appear in the Court below within a period of four weeks from today and make a prayer for bail, the same shall be considered and disposed of on its own merit in the light of the observations made in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004(3) PLJR, 491.

With the above direction/observation, this application is disposed of.
