This application, for grant of anticipatory bail, arises out of Pakridayal Police Station Case No. 51 of 2016, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioner tried to disturb in the election process. Learned Counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The alleged occurrence is said to have taken place in course of election relating to Gram Panchayat. Altogether 20 persons were named in the F.I.R. including this petitioner but no specific

Merely on the political rivalry, the petitioner has been made accused in the present case. Moreover, co-accused have been granted anticipatory bail by vide Cr. Misc. No. 52534 of 2016, Cr. Misc. NO. 41741 of 2016, Cr. Misc. No. 37952 of 2016, Cr. Misc. No. 37827 of 2016 and Cr. Misc. No. 36924 of 2016.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, East Champaran at Motihari in connection with Pakridayal Police Station Case No. 51 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
