1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In view of the explanation furnished by the learned counsel appearing on behalf of the petitioner, the defect, as pointed out by the office, is hereby ignored.
3. The petitioner apprehends his arrest in connection with Mushahari P.S. Case No. 13 of 2020 registered for the offences punishable under Sections 147, 148, 149, 341, 324, 323, 307, 504, 506 and 427 of the Indian Penal Code.
4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 01.01.2020 at 06:00 AM all the accused persons including the petitioner came and started assaulting him, it is further alleged that Baban Singh assaulted him by sword

No.59114 of 2025(3) dt.03-09-2025 2/3 causing injury on head, thereafter petitioner assaulted by an iron rod on the back side of the head causing open head injury, further Md. Azad fired on the informant, but missed, it is next alleged that the reason for the occurrence was that Baban Singh took an amount of Rs. 3 Lakhs from the informant, but the land was sold to some other person and when informant demanded his money back from Baban Singh, when the occurrence is alleged to have been committed.
5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the dispute of the informant was with Baban Singh, it is next submitted that since petitioner is associated with Baban Singh, hence, he also came to be implicated.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that there is a specific allegation against petitioner and Baban of assaulting the informant by an iron rod and sword. It is also submitted that the informant suffered multiple injuries on vital part of the body, as recorded in the order impugned and was admitted in SKMCH, Hospital. It is also submitted that the case is of the year 2020
Patna High Court CR. MISC. No.59114 of 2025(3) dt.03-09-2025 3/3 and investigation is going on.
7. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
8. Accordingly, the instant anticipatory bail application stands rejected.
