JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The petitioner is apprehending his arrest in connection with Ahiyapur P.S. Case No. 281 of 2015, registered for offences punishable under Sections 341, 447, 448, 323, 324, 307, 354, 379, 504, 506/34 Indian Penal Code.

It has been submitted on behalf of the petitioner that prior to filing of the present case, son of the petitioner had already lodged a case against the sons of informant, which is Ahiyapur P.S. Case No. 271/15 and only due to the said fact, present false case has been filed. Further it is alleged that petitioner assaulted on the head of the informant, however the injuries caused to the informant from the said assault was found to be simple in nature. Heard learned A.P.P. also.

Having heard both sides, in view of the fact prior to filing

Patna High Court Cr.Misc. No.7505 of 2017 (3) dt.29-03-2017 2/2 of the present case, son of the petitioner had already filed a case against the sons of the informant and also the injury caused to the informant from assault by the petitioner, was found to be simple in nature, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 281/15, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
