JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 31.12.2015 in a case registered for the offences punishable under Sections 498A, 341, 342, 323, 324, 307, 379 and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture and causing burn injury for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the injury of the informant has been found to be simple. There is counter version of the occurrence also and petitioner's mother received grievous injury.
Learned A.P.P. after going through the case diary
Patna High Court Cr.Misc. No.8637 of 2016 (3) dt.18-03-2016 2/2 submits that the altogether seven injuries have been found on the person of the informant.
Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail is rejected in connection with Sikta P.S. Case No. 96 of 2015 pending in the court of learned SDJM, Bettiah, West Champaran.
Let the trial be expedited.
