Informant is not an eye witness of the alleged occurrence nor any witness claimed to have seen the actual killing of the deceased. Moreover, the informant named the petitioners and others on the ground that prior to the alleged occurrence, a quarrel had taken place between Mishri Lal and Kalamuddin Ansari and deceased had pacified the aforesaid quarrel and that is the reason of lodging of this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that no
