Learned counsel for the petitioner fairly submits that during the pendency of the writ petition, the original petitioner has been died long back and the legal heirs of the petitioners has not come forward to substitute in the present proceeding and despite several indulgance, he could not get the instruction from the legal heirs of the original petitioner.

3. In view of the aforesaid, learned counsel for the
