JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The alleged occurrence is said to have taken place on account of family dispute. Petitioner is named in the first information report along with several other persons and general allegation of assault has been leveled against the petitioner and other accused. There is case and counter case between the parties also in which it is stated that it was prosecution party who assaulted the petitioner and his other family members. The impugned order reveals that the deceased died of his head injury but it is not specific who caused head injury to the deceased. Petitioner is in jail custody since 17.06.2015 and the investigation against him has already been completed.

Patna High Court Cr.Misc. No.11296 of 2016 (2) dt.14-03-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Masaurhi, Patna in connection with Pipra P.S.Case No. 16 of 2015.
