Diverse counter affidavits/supplementary counter affidavits have been filed on behalf of the concerned respondents. The present application seeks a direction upon the authorities to produce the petitioner before the learned Trial Court in connection with trial arising out of Sitamarhi P.S. Case No. 26 of 2010 as he is lodged in Central Jail, Gaya. It is stated that the presently the petitioner is lodged in the District Jail, Darbhanga.
Patna High Court Cr. WJC No.375 of 2015 (3) dt.13-12-2016 2/2 In the counter affidavit filed on behalf of respondent nos. 4 to 7, it is stated that the petitioner was produced in the Court in the said case on 12.05.2016 wherein the next date was fixed as 24.05.2016 when the petitioner shall be produced on appropriate order of the Court before the Trial Court.
Counsel for the State, referring to Annexure-B to the supplementary counter affidavit of respondent no. 8, submits that the District and Sessions Judge, Sheohar has already passed an order on 07.05.2016 for production of the accused who is security threat to the society through video conferencing from different jail in course of the pending trial.
In view of the above, the Court, in the present facts and circumstances of the case, considers the application as having become infructuous. It is dismissed as such.
