JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Masaurhi P.S. Case No. 211 of 2015 registered under Sections302/34 of the Indian Penal Code. Informant alleged that her husband has been killed by the named accused persons with intention to grab the property. It is further alleged that accused persons had earlier also made attempt to kill her and her husband, for which Masaurhi P.S. Case No. 58 of 2014 was registered. Learned counsel for the petitioners submits that the present case has been lodged after four months of the occurrence. There is no specific allegation against these

The husband of the informant was a drunkard and perhaps in depression committed suicide, for which petitioner no. 2, being his father, had lodged a U.D case. Informant had participated in his last rites. Informant has two sons from the deceased, who are the legal heirs of the deceased and petitioners would not inherit the property. Similarly situated co accused persons have been granted bail by this Court vide order dated 15.12.2016 passed in Cr. Misc. No. 45341 of 2016. Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 211 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
