The petitioner has raised a grievance about violation of the order dated 3.5.2012 passed by this Court in C.W.J.C. No.6866 of 2012.

A show cause has been filed from where it appears that Government has decided not to initiate the departmental proceeding on the charges dated 17.2.2011 and also made

Patna High Court MJC No.261 of 2015 (3) dt.10-03-2017 statement in paragraph 6 that no departmental proceedings have been initiated hence the petitioner is entitled for getting his salary with three increments and consequential retiral benefits. In paragraph 7 it has been stated that steps are being taken to pay the same to the petitioner and necessary orders in this regard have already been issued vide letter no.277 dated 30.1.2017. In paragraph 8 it has been stated that the Joint Secretary, Department of Social Welfare, Patna vide letter no.874 dated 3.3.2007 requested the Accountant General, Bihar for issuance of revised authority slip so that pension can be revised.

In such view of the matter, there is no need to proceed further in the matter.

Accordingly this application is consigned.
