Petitioner seeks bail in Obra P.S. Case No.104 of 2019 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.

In the written report, there is specific allegation against co-accused, Baban Yadav, of firing from pistol on brother of the informant on account of which he sustained injury on neck and fell down. He was declared dead in the hospital. The co-accused made firing in air and fled away. Case diary has been received, wherein, postmortem report is available. Doctor has found one firearm injury on the person of deceased.

There is general and omnibus allegation against the

Petitioner is in custody since 27.04.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Aurangabad, in connection with Obra P.S. Case No.104 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
