JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-02-2022 This case has been heard through video conferencing. The petitioner apprehends her arrest in connection with Karpi P.S. Case No. 171 of 2020 registered for offence punishable under sections 420, 467, 468, 471, 120 (B) of the Indian Penal Code.

As per allegation, the petitioner has been appointed as Shiksha Mitra and on suspicion, her mark-sheet of Intermediate was sent to the Bihar School Examination Board (herein after referred to as BSEB) for verification and report, the report of BSEB was received and it has been mentioned in the report that the petitioner has obtained 499 total marks whereas her marks, as per record of D.P.O. (Establishment), Arwal, is 516. On previous date, the learned counsel for the petitioner has submitted that after re-evaluation, her total marks was

Thereafter, on 20.01.2022 the learned counsel for the BSEB appeared and submitted that the mark-sheet of the petitioner was created by the Board and after adding 48% marks of practical, aggregate marks has come as

516. The Law Officer of Bihar School Examination Board, Mr. Umesh Prasad Singh has also filed an affidavit in this respect. As per direction of this Court, this fact was communicated to the Investigating Officer and in this respect, a supplementary affidavit has been filed.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of her arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No. 171 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
