The petitioners apprehend their arrest in connection with Lakhisarai P.S. Case No.463/16 registered under Sections 341, 342, 323, 325, 307/34 of the Indian Penal Code. The accusation is that on 3.9.2016 at 7.30 P.M. when the informant was going from his house on Motorcycle, in the way both the petitioners having iron rod and pistol surrounded the informant and petitioner no.2 pointed pistol at the temple region of the informant. Petitioner no.1gave iron rod blows on the informant causing injury on his head and both hands as a result of which he became unconscious.

No.5137 of 2017 (2) dt.18-03-2017 2/2 Learned counsel for the petitioner submits that, in fact, due to grudge and enmity occurrence of mar pit took place in between the informant and the petitioners in which petitioner no.1 sustained grievous injury regarding which Lakhisarai P.S.Case No.464/16 had been instituted under Sections 147, 148, 149, 323, 325, 307, 354, 448 and 504 of the I.P.C. on the basis of written report of petitioner no.1. Moreover, three injuries were found on the person of the informant out of which injury no.2 was simple in nature where opinion about nature of injury No.1 & 3 was kept reserved.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai, in connection with Lakhisarai P.S. Case No.463/16, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) AnilKrSinha/- U T
