The application with respect to petitioner no. 2 has already been withdrawn.

The petitioner no. 1 and 3 seek bail in anticipation of their arrest in connection with Chandi P. S. Case No. 394 of 2020, dated 30.08.2020, instituted for the offences under Sections 341, 323, 325, 307, 504 and 34 of the Indian Penal Code.

There is a general and omnibus allegations against

Patna High Court CR. MISC. No.545 of 2021(3) dt.30-06-2021 2/3 petitioner nos. 1 and 3 of having assaulted the informant and others. Most of the injuries on the persons of the victims are simple in nature. However, one Rohit has received a grievous injury which is not attributed to any one of the petitioners in particular but such injury is only on the elbow. Regard being had to the background facts and the afore-mentioned grounds, the petitioner no. 1 and 3, abovenamed, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs.

10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa (Nalanda), in connection with Chandi P. S. Case No. 394 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. While saying so, this Court has also taken note of the fact that the there is a counter version of the occurrence and that petitioner nos. 1 and 3 do not have criminal antecedents.
