JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.9.2015 in a case registered under Sections 363 and 366A/34 of the Indian Penal Code.
The informant claims that in the evening of 31.7.2015 his daughter went to the house of the petitioner, but she did not return to her home and when her mother went in search of the victim, one Uma Kant Prasad disclosed that the victim was taken away by the petitioner and other F.I.R. named accused by a vehicle, but admittedly, the informant lodged the present case on 6.8.2015, i.e., after six days of the alleged occurrence. The victim is still traceless, but submission on behalf of the petitioner is that the victim was in love with Anil Sahani, who happens to be son of
Patna High Court Cr.Misc. No.12357 of 2016 (2) dt.18-03-2016 2/2 the petitioner and as a matter of fact, victim eloped with aforesaid Anil Sahani and the where about of victim and Anil Sahani is not known to the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in connection with Sonbarsa P.S. Case No.119 of 2015.
