2. The petitioner is in accused in a case under Sections 347, 341, 323, 308, 427, 354 and 379/34 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner along with other co-accused persons came at the informant's house and started firing at the informant and other co-accused persons along with petitioner assaulted the informant by means of lathi and danda.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and all Sections are bailable except Section 302 of the IPC and

Patna High Court CR. MISC. No.50174 of 2024(2) dt.20-07-2024 2/2 allegation of firing is against co-accused Gautam Singh and not against this petitioner and the injury caused by the petitioner is found to be simple in nature and petitioner is in custody since 17.01.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Parbatta P.S. Case No. 86 of 2023.
