JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 This application has been filed for transfer of Maintenance Case No. 303(M) of 2017 from the Court of Principal Judge, Family Court, Patna to the Principal Judge, Family Court, Samastipur on the ground that he has filed a partition suit before the Sub-Judge, Samastipur, which is pending and as such it would be convenient for the petitioner if the Maintenance case is transferred to Samastipur. It is also submitted that opposite party No.2 is residing at Samastipur. In this case notice was issued to opposite party No.2 but in spite of best efforts notice has not been served upon her. In the facts and circumstances, the ground taken by the petitioner for transfer of maintenance case does not appear
Patna High Court CR. MISC. No.11124 of 2018(8) dt.24-06-2019 2/2 to be convincing as she has filed the maintenance case before the Family Court, Patna in the year 2017 and the same could have been disposed of, had petitioner co-operated in disposal of the case. Petitioner is directed to appear in Maintenance case at Patna.
Accordingly, this application is dismissed.
