JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he got transferred the lands of informant by placing forged lady and got executed sale deed in his favour but submission on behalf of the petitioner is that the petitioner is a bonafide purchaser and, as matter of fact, there is land dispute between the informant and the vendor of the petitioner. It is further submitted that investigation against the petitioner has already been completed and petitioner is in jail custody since 11.02.2016. Moreover, having more or less similar allegation, some co-accused are enjoying the privilege of bail.

No.16075 of 2016 (2) dt.21-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S.case No. 87 of 2015.
