2. The petitioner, husband of opposite party no. 2, apprehends his arrest in a case registered for the offence under Sections 494, 498(A), 341, 342, 323, 34 of the Indian Penal Code.
3. It is alleged that informant was married to this petitioner about 11 years ago and out of the wedlock, one female child was born, but thereafter, all the named accused persons including this petitioner subjected her to cruelty and harassment due to non-fulfillment of additional demand of dowry and ultimately, she was ousted from her matrimonial home. It is also alleged that this petitioner solemnized second marriage with one Bharti Devi.

However, at the outset, learned counsel for the petitioner contends that the dispute between the parties has been settled with mutual consent and both parties have agreed to live separately and in support of the same, petitioner has brought on record copies of separation petition and permission petition, filed by the informant/opposite party no. 2 before the court of learned J.M. 1st Class, Araria, vide Annexures P/3 & P/3-A to this petition.
5. Learned counsel for the opposite party no. 2 does not dispute the aforesaid contention and confirms the fact regarding the settlement entered into between the parties.
6. In view of aforesaid facts and circumstances, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail-bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Araria in connection with Sikti (Bardaha) P.S. Case No. 112 of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
