The petitioner apprehends his arrest in connection with Amarpur (Fullidumar) P.S. Case no. 249 of 2016, registered under Section 406 of the Indian Penal Code.

The accusation is that petitioner being the camera operator was asked to submit the C.D. of C.C.TV camera footage for counting work of Panchayat Election 2016 of 02.06.2016 and 03.06.2016, but petitioner could not provide the C.D. of C.C.TV footage of 02.06.2016.

Learned counsel for the petitioner submits that the petitioner being the camera operator operated the CCTV footage for counting work of Panchayat work on 02.06.2017 and 03.06.2017, but due to technical mistake CCTV footage of 02.06.2016 could not be

Patna High Court Cr.Misc. No.2299 of 2017 (2) dt.07-02-2017 2/2 restored and due to that reason it could not be supplied. Further submission is that there was no intentional latches on the part of the petitioner rather due to technical mistake he could not save the C.C.TV footage of 02.06.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 249 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
