The petitioner apprehends his arrest in connection with Karandey P.S. Case No.23 of 2016 registered under Section 306 of the Indian Penal Code.

The accusation is that on 14.06.2016, in the evening at about 07.00 P.M., a quarrel took place in between Usha Devi, the sister-in-law of the informant, and her husband Sohrai Mahto (petitioner). Thereafter, Sohrai Mahto came to the godown from the house. At that time, the informant was present in the godown. After sometime, hulla was raised that Usha Devi set herself on fire, then the informant alongwith others went to the house and saw Usha Devi burnt badly and also saw that the people were

Patna High Court Cr.Misc. No.2393 of 2017 (3) dt.27-03-2017 2/3 extinguishing the fire. After extinguishing the fire, they took Usha Devi to Jamui for treatment but she died on the way. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased Usha Devi and due to wedlock of the petitioner and the deceased Usha Devi, there are three children. In fact, in the evening of 14.06.2017, the hot exchange of words in between the petitioner and the deceased Usha Devi took place and, thereafter, the petitioner left the house and came to the godown and, at that time, the informant was also present at the godown.

In the night, hulla was raised that the deceased Usha Devi set herself on fire and on reaching there by the informant and others, the fire was extinguished and the deceased Usha Devi was rushed to the hospital for treatment but she died in the way. In course of investigation, the father of the deceased Usha Devi and other witnesses have also stated the similar facts before the Investigating Officer. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
