The petitioner is languishing in custody since 03.12.2015 in connection with Mashrakh P.S. Case No. 345 of 2015 for the offences instituted under Section 379 of the IPC. The prosecution case, in short, is that the motorcycle of the informant was stolen away by unknown person. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.12.2015 and the charge sheet has been submitted in the present case. Except for the confessional statement of the co-accused there is no substantive material to implicate the petitioner in the present case. On behalf of the State it has been submitted that the
Patna High Court Cr.Misc. No.20234 of 2016 (3) dt.19-07-2016 2/2 stolen motorcycle is recovered from possession of the petitioner and there are two other cases of similar nature pending against the petitioner.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Mashrakh P.S. Case No. 345/2015, pending in the court of the learned A.C.J.M.-II, Saran.
