Heard learned counsel Mr. Anil Kumar for the petitioner.
The learned Munsif, Pupri, Sitamarhi by the impugned order dated 04.02.2015 in Title Suit No.07 of 2014 has only allowed the application filed by the defendant-respondent for marking some documents which are public documents finding the same to be the necessary for just decision of the suit. It appears that the evidence of defendant is still going on. The court below has only directed to receive the documents filed by the defendant in evidence.
In such circumstances, in view of the decision of the Supreme Court reported in (2011) 11 Supreme Court Cases 275
Patna High Court CWJC No.5742 of 2015 (2) dt.28-03-2016 (K.K. Velusamy Vs. N. Palanisamy) I find no reason to interfere with the impugned order in exercise of supervisory jurisdiction. Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Harish/- U
