JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 354A of the Indian Penal Code and Section 8 of POCSO Act. Petitioner is said to have confined an eight years old girl in his room with mala fide intention. The statement of victim girl has been recorded under Section 164 of the Code of Criminal Procedure, in which, she stated that she was picked up by the petitioner and when she cried on, petitioner put his finger into her mouth and after that made her captive in a room. Except the aforesaid fact, victim has stated nothing against the petitioner. Petitioner is in jail custody since 20.01.2016 and the investigation against him appears to have already been completed.

Patna High Court Cr.Misc. No.18837 of 2016 (2) dt.03-05-2016 2/2 Accordingly, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Naokothi Police Station Case No. 07 of 2016 (POCSO Case No. 05 of 2016) to the satisfaction of learned Additional Sessions Judge-1-cum- Special Judge, Begusarai.
