2. The petitioner seeks bail in connection with Mairwa P.S. Case No. 171 of 2024 registered for the offences under Sections 307/34 and 302 of the IPC and Section 27 of the Arms Act.
3. The petitioner is not named in the F.I.R.
and is in custody since 26.12.2024.
4. As per the FIR, the younger brother of the informant was shot dead by named accused person namely Vishal Tiwari along with other unknown co-accused persons.

It is pointed out by the learned counsel appearing on behalf of the petitioner that name of this petitioner transpired in this case during course of investigation on the basis of confessional statement of Vishal Tiwari, in furtherance of which no incriminating material transpired during course of investigation so as to connect petitioner with the present occurrence of murder and considering the said fact that, co-accused Ajit Rajbhar has already been granted bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 38526 of 2025 vide order dated 06.08.2025. It is submitted that investigation of this case has already completed and as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.
6. Learned APP appearing on behalf of the State, opposes the prayer for bail.
7. In view of aforesaid facts and circumstances as mentioned above and by taking note of the fact as prima-facie except suspicion arising out of confessional statement of co-accused

No.43093 of 2025(2) dt.25-08-2025 3/3 nothing incriminating appears against the petitioner, who is a man of clean antecedent and moreover investigation of this case has already completed where petitioner remains in custody since 26.12.2024, accordingly above named petitioner, is directed to be released on bail in connection with Mairwa P.S. Case No. 171 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. -III, Siwan/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of the B.N.S.S.
