The petitioner is languishing in custody in connection with Shahpur P.S. Case No.359 of 2014 for the offences instituted under Sections 302/201/34 of the Indian Penal Code. The prosecution story in brief, is that petitioner and his family member had killed the daughter of the informant and attempts to dispose the dead body of the daughter of the informant. It is further alleged that earlier the petitioner and her family members tortured the daughter of the informant. It has been submitted on behalf of the petitioner that petitioner is in custody since 31.12.2014. Charge sheet has been submitted under Section 306 of the Indian Penal Code and charge

Patna High Court Cr.Misc. No.22685 of 2016 (4) dt.03-08-2016 2/2 has also been framed under section 306 of the Indian Penal Code. Prior to commission of the alleged offence, there was some hot exchange of words between the petitioner and the deceased and for the said reason she committed suicide. Except for this there is no other material to suggest the implication of the petitioner in the present case.

On behalf of the State it has been submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 6th, Bhojpur, Arrah, in connection with Shahpur P.S. Case No. 359 of 2014 (S. Tr. No. 250 of 2015).
