JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 45 of 2016, registered under Sections 363, 366(A) and 370/34 of the Indian Penal Code. The accusation is of kidnapping of daughter of the informant by Soni Khatoon and Khusbu Kumari, who are the wife and daughter of this petitioner.

Learned counsel for the petitioner submits that, in fact, petitioner is the husband of co-accused, Soni Khtoon and father of co-accused, Khusbu Kumri due to that reason he has been implicated in the present case with false allegation. No.2430 of 2017 (2) dt.28-02-2017 statement, under Section 164 Cr.P.C., in which, she stated about kidnapping her by wife and daughter of petitioner but due to pressure of the family members, the victim stated that this petitioner while searched the victim and he threatened to not disclose the name of his wife and daughter as culprits. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Raghopur P.S. Case No. 45 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
