In this case, the petitioner is seeking anticipatory bail in connection with Nautan P.S. Case No. 171 of 2021 registered for the offence under Section 341, 323, 324, 325, 307 of the Indian Penal Code.

Learned counsel for the petitioner submits that in this case the petitioner had executed bond under Section 41 of the Cr.P.C. and therefore, their case may be disposed of in light of the ratio laid down in the case of Mahendra Prasad Singh Vs. State of Bihar reported in 2004(3) PLJR 491.

Considering the aforesaid, this anticipatory bail application is disposed of with a direction to the Court below that when the petitioner appear and prays for bail after submission of the chargesheet, it may be treated as his first appearance. (Sandeep Kumar, J) siddharthkr/- U T
