The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 324, 354, 337, 504, 506 and 34 and 302 of the Indian Penal Code. As per prosecution, it is a case of assaulting by the accused persons along with other accused. The specific allegation against the petitioner is that he also assaulted the deceased (informant husband) by brick due to which he succumbed injury. It is submitted that many persons as alleged assaulted to the deceased but postmortem report shows only two lacerated wound and two injuries found by the doctor conducting the postmortem report.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.44419 of 2022(4) dt.06-02-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 10.01.2022. Learned APP appearing for the State has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ladaniya P.S. Case No. 03 of 2022 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureities of the like amount each to the satisfaction of learned C.J.M., Madhubani.
