JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehends his arrest in connection with Naya Ramnagar (Safia Sarai) P.S. Case No. 145 of 2016, registered for the offence punishable under Section 30 of the Bihar Prohibition of Excise Act, 2016.
Allegedly, Sanjit Kumar @ Gidara was arrested and from his possession one bottle of illicit foreign liquor was recovered and he disclosed that the same was given by the petitioner.
Submission is of false implication and due to previous enmity the mother of the petitioner and mother of the coaccused were candidates in panchayat election and due to that the
Patna High Court Cr.Misc. No.2714 of 2017 (2) dt.31-01-2017 2/2 co-accused has named the petitioner, resulting, the petitioner is apprehending his arrest in this false case.
The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, considering that nothing has been recovered from conscious possession of the petitioner or from his house and co-accused has stated the name of the petitioner before the police and as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar, learned Additional Chief Judicial Magistrate 1st Munger, in connection with Nay Ramnagar (Safia Sarai) P.S. Case No. 145 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
