JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Bakhtiyarpur P.S. Case No. 147of 2015 registered for the offences punishable under Sections 376, 511, 341, 323/34 of the Indian Penal Code and Section 8 of POCSO Act.

Allegedly, co-accused Guruchand Yadav tried to outrage the modesty of minor daughter of the informant when she was cutting the grass in maize field and when complaint was made the petitioners assaulted the informant and his wife. Submission is of false implication and that against the petitioners there is only allegation of assault. The main allegation is against co-accused and as such the petitioners deserve

Patna High Court Cr.Misc. No.1659 of 2017 (2) dt.18-01-2017 sympathetic consideration to which learned APP fairly submits that the main allegation is against co-accused Guruchand Yadav. In the facts and circumstances stated above, the petitioners above named, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 147 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
