JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the first information report nor any stolen article is said to have been recovered from conscious possession of the petitioner. Petitioner is in jail custody since 22.01.2016 but he was not put on Test Identification Parade. The impugned order of learned Additional Sessions Judge goes to show that petitioner was remanded in this case from other cases on the basis of confessional statement and, therefore, it appears that except confessional statement as well as some criminal antecedent of the petitioner, there is nothing against him. Considering the aforesaid facts and circumstances as

No.22978 of 2016 (3) dt.24-06-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 655 of 2015.
