The petitioner is apprehending his arrest in connection with Complaint Case No. C 1420 of 2015 (Trial No. 318 of 2016), registered for offences punishable under Section 498A of the I.P.C.

It is submitted on behalf of the petitioner who is the husband that he has taken his wife to his house and she was assured that he will keep her with affection and care. On the other hand, learned counsel for opposite party no. 2 has appeared in this case and it has been submitted that it is true that she is residing with her husband but his behaviour is still not good.

Patna High Court Cr.Misc. No.4323 of 2017 (3) dt.20-04-2017 Considering the aforesaid aspect of the matter, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below on 03rd May, 2017 and on that date the opposite party no. 2 shall remain present in Court and if the Court is satisfied with the conduct of both the parties, he will release the petitioner on provisional bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to his own satisfaction and shall watch the conduct for a period of six months by calling them on a date fixed in each month in the Court and only after satisfied with their conduct and matrimonial relationship after six months, he will confirm the bail bond of the petitioner otherwise he is free to pass any order as he deem fit and necessary.

With the aforesaid observation, this application is disposed of.
