The petitioner is apprehending his arrest in connection with Brahmapura P.S.case No.321 of 2017 dated 17.12.2017 (GR No.5907 of 2017)registered for offences punishable under Sections 406/420/34 of the Indian Penal Code. Allegation against the petitioner is of approaching the informant for opening the Generic Medicine shop under the Pradham Mantri Yojna collected Rs.4 lakh from him and for that two cheques have been issued only on instruction of the petitioner by another co-accused persons but no licence of shop has been given to the petitioner and later on when he approached the petitioner, he got returned Rs.85,000/- in the account of the informant.

No.10697 of 2018 (3) dt.23-04-2018 2/2 Submission of the learned counsel for the petitioner is that no way he has taken cheques and he is a responsible Doctor and he has been falsely implicated in the present case. Heard learned A.P.P. and the learned counsel for the informant.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
