JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 This is an application for grant of anticipatory bail in connection with Rajauli P.S. Case No. 106 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 379, 387 of IPC.
Prosecution story is that accused persons including the petitioners variously armed came to the informant and demanding Rangdari on the occasion of Holy and there is specific allegation of assault against all the petitioners, causing injuries to him.
Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.43058 of 2019(2) dt.12-07-2019 2/2 is that there is case and counter case between the parties and a case has been lodged by the petitioners for assault to his nephew, who is running a shop at the bus stand and also to other persons. He further submitted that though the injuries are grievous or simple in nature but the same are not on the vital part of the body.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No. 106 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
