JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-03-2023 It is submitted on behalf of petitioner that supplementary affidavit has been filed with respect to correction in the address portion of petitioners, as inadvertently the father's name of petitioner nos. 1 and 2 has been interchanged. Let the same be corrected during course of the day and read as Pramod Singh @ Pramod s/o Bacha Singh @ Bachcha Singh and Pawan Singh, s/o Ram Kripal Singh. Heard counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. Prosecution case in brief is that on the alleged date and time of occurrence while the informant's elder brother was

Patna High Court CR. MISC. No.44034 of 2022(3) dt.13-03-2023 2/2 returning from Sipaar, on the way, four miscreants riding on two motorcycles came and fired upon him, as a result of which he became seriously injured.

It is submitted that petitioners are not named in the FIR and they have been falsely implicated in this case due to business rivalry. The name of petitioners surfaced in this case on the basis of call detail report. Save and except the call detail report there is no material against the petitioners. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 578 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
