The petitioners seek bail in anticipation of their arrest in connection with Inarwa P.S. Case No. 7 of 2020, instituted for the offences under Sections 409, 420 and 120(B)/34 of the Indian Penal Code.
The petitioners are Ward President and Ward Secretary respectively and have been alleged to have bungled the amount which was meant for being spent on Mukhyamantri Gramin Payjal Nishchay Yojana.
It has been submitted on behalf of the petitioners
Patna High Court CR. MISC. No.743 of 2021(2) dt.24-06-2021 2/2 that without verifying the facts, the aforesaid F.I.R. has been lodged. Later, the informant himself gave a certificate that though there has been a delay in execution of the work, but the entire work has now been completed and there is no mishandling of the funds of the government.
Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Inarwa P.S. Case No. 7 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
