JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehends his arrest in connection with Parsa Bazar (Patna) P.S. Case No. 166 of 2016, registered for the offences punishable under Sections 498(A) and 379 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. The petitioner and opposite party no.2 are present. As per submission of opposite party no.2 the petitioner has brought mobile, cash of Rs. 4,000/- and one new ring which were given by the opposite party no.2. to the petitioner The opposite party no.2 received the same. The petitioner submits that he has not taken the ring of the opposite party no.2, but to avoid future complication, he has given the new ring, purchased by him.
Patna High Court Cr.Misc. No.2903 of 2017 (5) dt.20-04-2017 2/2 Under the circumstances, good sense has prevailed between the parties. The opposite party no.2 submits that she will reside separately and is not ready to live with the petitioner, she has got no complaint now against the petitioner. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna, in connection with Parsa Bazar (Patna) P.S. Case No. 166 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
