The petitioner is languishing in custody for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
Wife of the petitioner died after 12 years of her marriage and allegation is that she was done to death for nonfulfillment of dowry demand. FIR was lodged after cremation of the dead body.
Submission is that there is no eyewitness of the actual occurrence, rather the petitioner has stated on oath that the wife died of illness. Investigation of the case is already complete. Considering lack of direct material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two
Patna High Court CR. MISC. No.812 of 2021(3) dt.16-04-2021 2/2 sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kadirganj P.S. Case No. 21 of 2020 in S.Tr. No.279/2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
