The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 31.03.2016 passed in Cr. Misc. No. 5110 of 2016, in the light of observation made therein that the petitioner may renew his prayer of bail after framing of charge. It is submitted that on 23.04.2016 charges have already been framed and as such the petitioner now deserves sympathetic consideration as in near future the trial is not likely to be concluded and further there is no chance of tampering with prosecution evidence. Learned APP fairly submits that in view of earlier observation lenient view can be taken.

In the facts and circumstances stated above, the petitioner

Patna High Court Cr.Misc. No.22360 of 2016 (2) dt.18-05-2016 above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 885 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
