Learned Senior counsel for the petitioner submits that in the recovery proceedings arising out of Ex.(OA) 23/1999 and PT 4/1999 Debts Recovery Tribunal has auctioned the assets. However, proceed thereof is not being released in favour of the petitioner bank. It is submitted that matter is being prolonged unnecessarily and delay is detrimental to the Bank. Learned senior counsel submits that he would be approaching the authority under the Recovery of Debts due to Bank and Financial Institution Act so as to expedite the process keeping in view the fact that the interest involved is of public money.

In view of such submission, no further directions are

This court would however, observe that in the public interest, authority under the Act would proceed expeditiously and in accordance with law having regard to special nature of the Act. Writ petition is disposed of.
