The petitioners seek bail in connection with Special Excise Case No. 474 of 2021 arising out of Routa P.S. Case No. 62 of 2021, dated 17.06.2021, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

They are sought to be prosecuted in this case on

Patna High Court CR. MISC. No.55487 of 2021(2) dt.23-05-2022 2/2 account of recovery of 67.905 litres of liquor from a car belonging to them.

The petitioners are said to be in custody since 18.06.2021.

The petitioner No. 2 does not have criminal antecedents, whereas the petitioner No. 1 was earlier made accused in a case of similar nature.

However, considering the period of custody of the petitioners and the nature of accusation against them, they are directed to be released on bail on their furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Purnea in connection with Special Excise Case No. 474 of 2021 arising out of Routa P.S. Case No. 62 of 2021.

The application stands allowed.
