JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-12-2021 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Janta Bazar P.S. Case No. 100 of 2018 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. As per allegation, co-accused Chandan Kumar Singh has enticed away by giving assurance of marriage to the daughter of the informant and the allegation against the petitioner and other accused persons is that they assisted accused Chandan Kumar Singh in the alleged occurrence.

Learned counsel for the petitioner has submitted that the main allegation of taking away the victim after enticing her for

Patna High Court CR. MISC. No.40800 of 2020(2) dt.13-12-2021 2/2 marriage is on co-accused Chandan Kumar Singh. On similar footing co-accused Vikash Kumar Singh has been granted anticipatory bail by learned coordinate Bench of this Court in Cr. Misc. No. 267 of 2020 vide order dated 21.01.2020.

On the other hand, learned APP for the State has opposed the prayer for bail of the petitioners.

Considering the fact that the main accused against whom the kidnapping of the victim is alleged is co-accused Chandan Kumar Singh and on similar footing co-accused Vikash Kumar Singh has granted anticipatory bail by this court, let the petitioner be released on bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, in connection with Janta Bazar P.S. Case No. 100 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
