Present application is preferred by the applicant-wife making a grievance with respect to non-compliance of the order passed by this Court on 17.07.2013 in C.W.J.C. No. 111/2012. 2.

Today, when the present application is taken up for further hearing, learned Counsel appearing on behalf of the applicant has stated at the Bar that the learned Counsel appearing on behalf of the respondent has handed over a Bankers' Cheque

Patna High Court MJC No.3126 of 2014 dt.04-10-2018 2/3 amounting to Rs. 1,25,000/- and 2 Bank Drafts each of Rs. 40,000/- (total amounting to Rs. 80,000/-), i.e. in all Rs. 2,05,000/-.

Learned Counsel appearing on behalf of the respondent-husband has stated at the Bar that all the aforesaid Drafts and Bankers' Cheque shall be encashed as and when the same are deposited and if it is found that any of the Cheque/Drafts is dishonoured, the necessary consequences may follow, including the contempt of the Court.

Now, responsibility remains with respect to Rs. 40,000/-. It is the case on behalf of the respondent-husband that Rs. 40,000/- is deposited and lying with the Family Court at Sasaram. The aforesaid submission is disputed by the learned Counsel appearing on behalf of the applicant. 5.

Learned Counsel appearing on behalf of the respondent to give particulars with respect to the deposit of amount of Rs. 40,000/- lying with the Family Court, Sasaram to the learned advocate appearing on behalf of the applicant within a period of two weeks from today and thereafter it will be open for the applicant to withdraw the said amount.

Thus, considering the aforesaid, it can be said that the order passed by the learned Single Judge has been substantially complied with.

Under the circumstances, the application stands disposed of. As the application stands disposed of, the earlier stay order naturally stands vacated.
