ANJANA MISHRA ORAL ORDER 31-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 19.12.2015 in connection with Shikarpur P.S. Case No. 515 of 2015 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the petitioner has been included in the F.I.R. only on the basis of suspicion. It is further submitted that the petitioner and others had gone along with deceased. Learned counsel for the petitioner further submits that though the occurrence is of 07.12.2015 and the dead body was recovered on 17.12.2015, there was no Sanha in the intervening period to indicate
Patna High Court Cr.Misc. No.23335 of 2016 (2) dt.31-05-2016 2/2 absence of the missing boy and no plausible explanation has been given regarding non- reporting of the disappearance of boy for ten days.
In view of the aforementioned facts and circumstances that the petitioner has no criminal antecedent, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, District-West Champaran in connection with Shikarpur P.S. Case No. 515 of 2015.
