JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the Vigilance Department, Govt. of Bihar and the learned A.P.P. for the State. The petitioner is accused in connection with Spl. Case No. 02 of 2012 arising out of Mushahari P.S. Case No. 08 of 2012, registered under Section 7, 8, 9, 11 and 13 of the Prevention of Corruption Act.
The accusation is that the petitioner being the husband of Panchayat Mitra Manju Devi has taken cash of Rs. 5000/- from the complainant Seema Devi for giving benefit under Indira Awas Yojana, while Rs. 2000/- was returned by the petitioner in presence of the Mukhiya, but Rs. 3000/- is to be returned.
Patna High Court Cr.Misc. No.20812 of 2016 (2) dt.19-05-2016 2/2 Learned counsel for the petitioner submits that, in fact, the present case has been lodged due to misconception of Seema Devi, but now the case has been settled in between the petitioner and the complainant regarding which compromise petition has also been filed on 22.03.2016 in the Court of Spl. Judge, Vigilance, Muzaffarpur. The petitioner having no criminal antecedent is in custody since 22.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Spl. Case No. 02 of 2012 arising out of Mushahari P.S. Case No. 08 of 2012.
