The petitioner apprehends his arrest in Sare P.S. Case No. 86 of 2016 instituted for the offence under Section 420, 467, 468, 120(B) and 279 of the Indian Penal Code and Section 47(A), 54 and 57 of Bihar Excise (Amendment) Act, 2016. It has been submitted that total 715 bottles of foreign liquor was recovered from the dickey of the vehicle. The petitioner is said to be the driver of the aforesaid vehicle. From the seizure list as well as written report itself, it appears that the petitioner was not present on the spot. It has been submitted that the owner of the aforesaid vehicle has been granted bail by Co-ordinate Bench of this Court vide Cr. Misc.

Patna High Court Cr.Misc. No.5016 of 2017 (2) dt.16-02-2017 2/2 No. 1186 of 2017 dated 16.01.2017. It is mentioned in para-3 of bail petition that petitioner has no criminal antecedent. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Sare P.S. Case No. 86 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, subject to the conditions as laid down under Section 438(2) Cr.P.C.
