1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109(1), 303(2), 352, 351(3) and 3(5) of the BNS.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on account of dispute relating to land Subodh Paswan assaulted the informant by rod causing injury on his head, while Kamlesh Paswan (petitioner no. 2), Nandu Paswan and Muresh Paswan assaulted his brother Pashupati Prasad with spade and rod causing head injury and fracture of jaw. Thereafter, Nandu, Ramprit and Mahendra assaulted Ram Vilash
Patna High Court CR. MISC. No.43673 of 2025(2) dt.16-07-2025 2/3 Paswan by stick and accused also snatched gold chain, ring and Rs.5000/- of the informant.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that from the side of the petitioners also Hulasganj P.S. Case No. 316 of 2024 was instituted. It is also submitted that Ramprit Paswan (petitioner no. 1) is a differently abled person as would manifest from Annexure-P/3 and is suffering 75 per cent disability in his both legs. It is submitted that allegation against Ramprit Paswan (petitioner no. 1) is of assaulting Ram Vilash Paswan by stick along with Nandu and Mahendra.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners and submits that no doubt Ramprit Paswan (petitioner no. 1) along with Nandu and Mahendra are alleged to have assaulted Ram Vilash Paswan by stick but then as far as Kamlesh Paswan (petitioner no. 2) is concerned he is alleged to have assaulted Pasupati Prasad along with Nandu and Muresh with spade and rod causing head injury and fracture of jaw.
6. After hearing the learned counsel for the parties, let petitioner no. 1, namely, Ramprit Paswan @ Bhushan Paswan,
Patna High Court CR. MISC. No.43673 of 2025(2) dt.16-07-2025 3/3 in the event of his arrest or surrender before the learned trial Court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Hulasganj P.S. Case No. 310 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. The Court is not inclined to extend the privilege of anticipatory bail to the petitioner no. 2, namely, Kamlesh Paswan.
8. Hence, the prayer for anticipatory of the petitioner no. 2 is rejected.
