The petitioner apprehends his arrest in Simultalla P.S. Case No. 28 of 2016 instituted for the offence under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code. There is specific allegation against this petitioner of assaulting the daughter of the informant Pratima Devi with Tangi on head and also assaulting by butt of axe on the head of son of the informant. The photocopy of injury report has been filed as Annexure-4, wherein doctor has fond incised wound on the occipital region of scalp on the person of Pratima Devi and incised wound on the frontal region of the scalp on the person of Mahendra Shaw, besides other injury as mentioned in injury

In such circumstances, there is specific allegation against this petitioner of assaulting two persons namely, Pratima Devi and Mahendra Shaw, which gets support from the injury report as mentioned above. Therefore, this court is not inclined to grant petitioner anticipatory bail.

Accordingly, this anticipatory bail petition is hereby rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law without being prejudiced by this order.
